The new 55 acre Housing Development, in prime Endangered Species Habitat

This is Lot-4. It was re-sold in 2024. At the top, you can see U Mass to the North, Hartford Connecticut to the south. It overlooks the Connecticut River Valley with a spectacular View of Springfield Mass. It recently sold for $300,000. This whole mountain is Mapped  Endangered Species -  by the  State Natural Heritage and Clear-Cut two years before my arrival. This area bulldozed in late 2009.

I'm parked on the gravel driveway that was just laid. It goes directly through the Lot-3 Wetland just being filled in. This land was just raised 4 feet. A full Russian crew started building the home. This is my son Derrick's land, 6 acres, Lot - 2, in late 2017. It was just mowed in the picture. The trucks location is where the official Septic Perc test passed. In 2019. This same land will be converted to a Wetland, by Levesque Associates, Westfield MA. A desperate 3rd Wetland relocation attempt by the State DEP because Wetlands Maps are not correct.

The States goal is for me to cross this new Wetland. A violation will allow the State to move their State Wetland on GIS Maps. The State figures I need to cross it to build on the other side. 

Levesque refused to let me tell him about the land as he continued. I wanted to tell him I already have a wetland.

Wetlands, raising land, blasting rock ledge, disturbing habitat areas, and continually moving the wetland boundaries.

 Walkowski continues to fill in his half of his wetland, all as the Attorney puts his home up for sale. He adds another 3 Triaxles of loam to fill in the remaining Wetland more, while I'm still under a cease and desist. Honest, that Wetland is fully filled in, well, almost.

There was much more. Blasting started early on to build the road which the Town built. I was told no contractor would take the road job because its a protected area.  

More blasting to build the road. Timber Rattle Snakes fled according to residents.

The west face of the mountain had many sunny ledges and habitat for the Timber Rattler. Fish & Game let the owner buy then blast. Blasting done without warnings to neighbors. Then he's put under a cease and desist. No warnings to neighbors.

Early, 2009, while the land was raised 10 feet in areas on lot-3. The septic system didn't pass. 

Euclid's moved large quantity's of earth and rocks. Levesque has the nerve to ask me if I disturbed any rocks? Ryan, his worker said this is protected Rattle Snake Habitat land and you mustn't touch any rocks accusing me of moving some. He didn't know I have pictures.

The developer installs his driveway, permit required?

   The Early Days:

The reason I visited Pitcher Street: 

It was in early August 2009.  I was hired to prepair the land and plant Meadowgrass Seed on LOT -1, Pitcher, a 6-acre lot. All tree stumps were removed and the wetland - small pond with cattails on lot 1 was dug out and expanded to be a pond. Permit required? No. 

   


   Attorney Kevin Walkowski - the Developer purchased the Pitcher Street land for $60,000. His mother was the Trustee, see Hampton County Deeds - to be added.  The Tekoa Mountain Development Project, with covenants, was started in the year 2003. The land KW purchased at Pitcher Street Montgomery Mass was subdivided into 7 building lots already. 



  The Montgomery Conservation Commission's - representive, Ms. Paige Liberty who is also a realtor in town was very concerned about me making sure the jobs completed at our Property in 2010 were done correctly when I asked about our driveway permit. It has to be signed off by the highway dept she said. Kevins was being installed on lot 3. His is driveway almost done but before I could officially apply for ours or attend a meeting, we received notice of cease and desist on lot #2. I didn't grade it but did plant meadow grass.  

No Environmental Scientist, no study was needed at Lot 3 yet Conservation knew it was a wetland and approved the driveway? Paige's job was to check the state maps. This done before utilities and utilities were in.  and it was obvious it was wet because it was already clear cut in the wetland and she ignored it - map or no map.

   The State DEP and Natural Heritage sent us a letter saying they would pay us a visit to do a walk around the following Spring but issued the Hale's lot-2 a cease and desist before the ground froze. 

     They walked our land in the spring but not Kevin's. I had wanted my money back right after the driveway was installed because water was flowing across our property and Kevin said he knew people at the DEP so don't worry, I'll fix it by running g the water between our lots.  The walk around proved it when they didn't look at the water issues coming from his property. 

Kevin wasn't there and it was his development, his covanents. Kevin was on Cocane according to his brother and was soon disbarred acording to rumor. 

So we have an attorney who is not ethical and State workers coluding with an unethical Attorney and accepting bribes because I delivered 18,000 just prior to the walkaround. 

The woman who Kevin connected us up with at United Bank was terminated when I paid off the Construction loan and it was convenient for them to hold us up and not let us build until Kevins Spec Home was completed. 2.5 years. 

 

In 2018, she basically said exactly the same, if we want to build, we must hire Levesque of Westfield, who are Environmental Scientists.  

   Derrick wanted to return home to build in 2009 until we were told to "Cease and Desist".

   This site is to expose the actions or lack of. The State of Mass, DEP who works with the many Town and City conservation people, dictates how things are done and as I've found out, the DEP Control's the outcomes of projects, works together with the Natural Heritage Departments and controls "Developments" in a very controlled and private way.    

  From my observations, opinions and favors seem to out weigh common sense and lawful actions. 

   

Kevin Walkowski 

  • Kevin W. not fined for clear cutting 50 acres.
  • Carl Hale made to pay the price for clear cutting 2004
  • Did not have to place 200 x 200 monuments to buid.
  • Did not have to let 2/3 his land grow back.
  • Not required to furnish survey for the Natural Heritage.
  • Did not show other side of wetlands, check?
  • Not provided hearing or court date to confront charges. 
  • Issued a cease and desist, no formal warning. 
  • Paige Liberty of CC stayed away, never saw her. Why? 
  • David Paulson of Natural Heritage signed off right away - 2019. 
  • In 2018, Build 2, DEP is not in icontrol, Levesque is. Now this land is scientific. Dep supports them - Before Kevin.
  • Our Driveway, 16 months in the approval process.
  • Russians next door took 2 months.
  • Spent 8000 for house prints 2010

   

   I feel my Constitutional and Civil Rights were violated for the past 5 years. Had another runin with Levesque and Stinson of the DEP. Their actions are confusing and they give no reasonable reasons for stalling us which has forced us to make changes to our lives.  Most of my problems go back to Mark Stinson, killing my sand and gravel operation.

   


 

 My son Derrick and I were also going into business together which never happened. The DEP's Environmental corruption has drastically changed our lives. Derrick would be heavy competition to the Levesque firm and they are directly working together just like insider trading with the University of Mass. I'm hearing they are a very corrupt and dirty firm. Derrick is not welcome in this City because of his honesty and education.

As abutter's we received no notices.  We should have been alerted to changes in wetland destruction, stream's rerouted, discontinued and reasons a cease and desist are active for us. We were singled out for everything. All secret, stalled us for 3 years.
