
Foundation footing was poured on 10/22/2009 and as seen in the photo, it's sitting on stone ledge one foot under the soil. The developer attempted to place his home almost 15 feet on our land at first. Catching this I had him move and may be a reason he became hostile. It was either the drugs or septic. I moved him closer to the mud. His Lot-2 was way too wet, "Wetland" it had an intermittent stream there too which he soon re-routed. Neither we nor the Town were notified of this change. Wetland soils being filled in. This land approved by the Town after 2004 when it was subdivided, it was known and obvious the land was very wet. This is being ignored, we had the chance to buy LOT-2 but chose lot 3 due to lots of water and mud and in August, it was a dry time of the season when I witnessed the mud. As a Certified Septic Installer, I notice things like this. Also, I noticed 4 different locations with completed perc tests on lot 2, so when Derrick came home, he agreed, it was Lot 2 or nothing. All water now drains to the left property line re-routed from the swamp areas. All water used to flow past the pond and join a brook.

Picture #3 What is seen in this picture is the land graded, cut so flows go between the two lots. Lot line is the stone on the right. The mud is from the old wetland being covered. The Conservation Commission never showed up but Town workers would drive by as witness daily, sometimes twice. Picture #4 While working on Lot 1, the contractor told CH later as witness that Lot 3 almost whole area would flood into a big swampy area then run off the mountain in the Intermittent Stream. The unused Culvert , under date stamp sits next to our property markers. Picture #5 Now on the same day 10/17 CH drives forward 20 feet to snap a picture of the added slope to raise the land so the water would now run on our property. As all his wetland was filled in, he said I want a nice looking lawn here. He routed the water between properties to be dumped over the mountain instead of joining the Intermittent stream, the way it was. Conservation again sent no notic

Picture#6 The driveway now stopped. The water overflows the pond due to rain runoff and runs towards DH's Lot 2. Foundation hole bulldozed. 10/17/2009 land is raised again to stop the flow to the old stream. Erosion taking place noticeable in the blow up pictures.
So, the Developer who has issued the rules of his covenants to landowners is in the proceess of building his home. What he's doing is really none of my business until the DEP arrives but they don't arrive even though KW is turned in - possibly by a neighbor who told me he violated a wetlands and then the DEP attacks me instead. They are not concerned with KW, When I ask is it ok to build, they do arrive, they talk to me. They walk our land, pay no attention to the KW property. They said you have a cease and desist. Stop all work.
